SEC clarifies whistleblower protection rules

On August 4, 2015, the SEC issued an interpretive release clarifying the protections against employer retaliation that the Securities Exchange Act of 1934 provides to whistleblowers.

The interpretive release states that “an individual who reports internally and suffers employment retaliation will be no less protected than an individual who comes immediately to the Commission.” Further, the release notes that “[p]roviding equivalent employment retaliation protection for both situations removes a potentially serious disincentive to internal report by employees in appropriate circumstances.”
